The SA Building Work Contractors Act 1995 governs every building work contract over $20,000 inc GST. For concreting, that captures most metro Adelaide driveways above 60m2 and almost every house slab. When BWC licensing applies to concreting
A BWC licence is required when the contract value is $20,000 inc GST or more (increased from $12,000 on 10 November 2025), OR the work forms part of a larger building project that triggers BWC requirements. Below $20,000 BWC is not legally mandatory in SA. Australian Consumer Law obligations still apply: fit for purpose, acceptable quality, no misleading representations.
The BWC licence is the master Building Work Contractor licence. There is no separate "concreter licence" in SA. Concreters operating above the $20,000 threshold must hold a BWC licence issued by Consumer and Business Services (CBS), optionally restricted to specific categories such as Class 1 residential building work.
How to verify a BWC licence
Search the CBS public register at secure.cbs.sa.gov.au/OccLicPubReg/LicenceSearch.php. The licence number, expiry, category, and any active proceedings show up. Always verify on the register, never accept "we are licensed" in conversation.
Builders Warranty Insurance
For residential building work over $20,000 inc GST, the concreter (as the builder) must take out Builders Warranty Insurance before any work starts. The insurance covers the owner if the builder dies, disappears, becomes insolvent, or has the licence cancelled. Period: 5 years for structural defects, 2 years for non-structural. Premium: roughly 0.5 to 1.5% of contract value.
Never pay a deposit on a job over $20,000 inc GST without seeing the Builders Warranty Insurance certificate.
Penalties for unlicensed work
Individuals: $30,000 to $60,000. Corporations: $150,000 to $250,000. The unlicensed concreter cannot legally enforce payment under the contract. The owner also loses access to CBS dispute resolution.
Required compliance paperwork
For a typical $20,000+ driveway or slab job, the concreter provides:
- Written quote with itemised inclusions (slab thickness, mesh grade, mix strength, finish, joints, expansion provisions).
- BWC licence number disclosed on the quote.
- Builders Warranty Insurance certificate for residential work over $20,000.
- Public liability insurance certificate.
- Concrete delivery dockets showing actual MPa supplied.
- Where required: council crossover approval, heritage approval, soil report (Class M or H sites).
- Tax invoice on completion with all amounts itemised.
Dispute resolution
Contact the concreter in writing first. If unresolved and the job was over $20,000, escalate to CBS. CBS investigates licence breaches, issues penalty notices, and provides conciliation. Civil damages proceed via SACAT. If the builder is insolvent, disappeared, or unlicensed, Builders Warranty Insurance applies.
